I. GENERAL PROVISIONS
1. These Terms and Conditions govern the use of the website Motopit.bg, as well as the relations in connection with the offering and sale of goods through the online shop and by phone.
2. The trader and party to the sales contracts is:

"KK Future" EOOD operates the online shop Motopit.bg and is referred to below as the "Trader" or "Motopit.bg".
3. Motopit.bg is a specialised online shop for motorcycle parts, consumables, oils, tyres, brake components, equipment and related goods.
4. These Terms and Conditions are available on Motopit.bg. Before placing an online order, the customer has the opportunity to review and accept them.
II. CUSTOMERS AND CONSUMERS
5. A customer of Motopit.bg may be a natural or a legal person.
6. A "consumer" is a natural person who acquires goods or uses services for purposes outside their trade or professional activity, in accordance with applicable law.
7. The rights that the law grants specifically to consumers, including the right of withdrawal in distance sales, apply only where the statutory prerequisites are met.
8. For purchases made by legal persons or by natural persons acting within their trade or professional activity, the special consumer rules do not apply, unless the law provides otherwise.
III. INFORMATION ABOUT THE GOODS
9. Motopit.bg provides information about the main characteristics of the products offered, including, depending on the specific item: brand, model, size, quantity, purpose, technical specifications and compatibility.
10. Product photos are for informational purposes. Minor changes to the packaging, label or visual presentation are possible where they do not change the characteristics of the product itself.
11. For spare parts and accessories, compatibility may depend on the brand, model, year, version, equipment or other technical characteristic of the motorcycle.
12. The customer should choose a product suitable for their motorcycle.
13. If in doubt about compatibility, the customer may contact Motopit.bg before ordering:
- at 0883 20 55 35; or
- at info@motopit.bg.
Motopit.bg will provide reasonable assistance based on the information provided by the customer and the available technical data.
14. Where the customer has provided inaccurate or incomplete information about their motorcycle, Motopit.bg is not liable for an incorrect choice resulting solely from that information.
This provision does not limit Motopit.bg's liability for false or misleading information about the product or its compatibility provided by the Trader itself.
IV. PRICES
15. Prices on Motopit.bg are stated in euro (EUR).
16. The selling prices published on the site are final for the customer and include VAT, where applicable.
17. The delivery price is not included in the product price, unless expressly stated otherwise.
18. At present, standard delivery via Econt is:
- EUR 3.00 to an Econt office;
- EUR 3.00 to an address with Econt;
- Free delivery over EUR 150;
The applicable delivery price is shown to the customer when placing the order.
19. Motopit.bg may offer free delivery above a certain order value or under other promotional conditions. When such an option is active, the specific conditions and threshold are published on the site.
20. In the event of an obvious technical error in a published price, Motopit.bg notifies the customer before fulfilling the order. The customer has the right to confirm the order at the correct price or to cancel it.
V. ORDERING AND CONCLUSION OF THE CONTRACT
21. An order may be placed:
a) through Motopit.bg;
b) by phone at 0883 20 55 35.
22. Creating a user account is not required for an online order, unless expressly stated otherwise for a specific functionality.
23. The customer provides the data necessary for processing and fulfilling the order and is responsible for its accuracy.
24. Before finally submitting the online order, the customer has the opportunity to check the selected products, quantities, final price, delivery method and price, and the data provided.
25. After the order is sent, the customer receives confirmation via the e-mail address provided or another appropriate channel.
26. Automatic confirmation of a received order does not constitute a guarantee of physical availability of every ordered item.
27. If necessary, Motopit.bg may contact the customer to:
- confirm availability;
- clarify delivery;
- verify the data provided;
- clarify compatibility;
- obtain other information necessary for fulfilment.
28. When an ordered item is not available, Motopit.bg notifies the customer promptly. A substitute product is not sent without the customer's consent.
VI. PAYMENT
29. At present, Motopit.bg offers payment by cash on delivery upon receipt of the shipment.
30. The payment methods in effect at the time of the order are shown when placing it.
31. Motopit.bg may subsequently add payment by bank card, bank transfer or other payment methods.
32. When additional payment methods are introduced, they are subject to the conditions shown on the site and the requirements of applicable law.
33. Motopit.bg does not request bank card details by phone, plain e-mail or another unsecured communication channel.
VII. DELIVERY
34. At present, deliveries by Motopit.bg are carried out via Econt:
- to an Econt office; or
- to an address specified by the customer with Econt.
35. For products in stock in Sofia, orders placed by 14:00 on a working day are usually processed and handed to the courier on the same working day. Orders placed after 14:00, as well as on weekends or official holidays, are usually processed on the next working day.
36. For products delivered on request, the specific or estimated delivery time is indicated on the product page or communicated to the customer before the order is confirmed.
37. Motopit.bg does not undertake a general obligation for all products ordered on request to be delivered within one fixed timeframe, since the timeframe may depend on the manufacturer, importer or supplier.
38. If no other period has been agreed, the statutory rules on delivery time apply. The Consumer Protection Commission (CPC) states that, in the absence of another agreement, the goods should be delivered within 30 days.
39. The timeframe may be affected by official holidays, delay by a supplier, courier workload, force majeure or other circumstances beyond Motopit.bg's reasonable control.
40. In the event of a significant delay, Motopit.bg informs the customer.
41. The customer should provide accurate delivery details and ensure the possibility of receiving the shipment.
42. If Motopit.bg introduces its own delivery service in Sofia in the future, the specific conditions, price and scope will be indicated on Motopit.bg before that service is used.
VIII. RIGHT OF WITHDRAWAL IN DISTANCE SALES
43. The consumer has the right to withdraw from a distance contract, without stating a reason, within a 14-day period, where the law grants such a right.
44. For a contract for the sale of goods, the period generally begins on the date on which the consumer, or a third party indicated by them other than the carrier, receives the goods.
45. To exercise the right of withdrawal, the consumer should inform Motopit.bg with an unambiguous statement before the period expires.

46. The consumer may also use the standard withdrawal form, included as Annex No. 1 to these Terms and Conditions, but its use is not mandatory.
47. Motopit.bg recommends that the customer first contact info@motopit.bg, after which they will receive up-to-date instructions for sending the goods and a specific Econt office/address for the return.
48. The described procedure is intended to facilitate returns and does not limit other legally permissible ways of exercising the right of withdrawal.
49. After validly notifying the withdrawal, the consumer should send or hand over the goods within the statutory period.
50. The direct costs of returning the goods are borne by the consumer, unless Motopit.bg has expressly agreed to pay them or the law provides otherwise.
51. Return shipments should not be sent cash on delivery at Motopit.bg's expense, unless this has been agreed in advance.
52. The consumer is liable only for the diminished value of the goods caused by handling other than what is necessary to establish their nature, characteristics and functioning.
Motopit.bg does not apply a general rule under which any unpacked item automatically loses its right of withdrawal. The current guidance of the CPC also distinguishes between the right of withdrawal and liability for the diminished value of a used or damaged item.
IX. REFUNDS UPON WITHDRAWAL
53. When the right of withdrawal is validly exercised, Motopit.bg refunds the amounts due to the consumer within the period provided by law.
54. The refund includes the price of the returned goods and, where the law requires it, the cost of the standard initial delivery.
The CPC states a 14-day period for the refund from notification of the withdrawal, subject to the statutory conditions.
55. If the consumer has expressly chosen a more expensive delivery method than the standard one, Motopit.bg does not owe the additional costs above the value of standard delivery, where the law allows this.
56. Motopit.bg may withhold the refund until the goods are received back or until proof of their dispatch is provided, where this is permitted by law.
57. For an order paid by cash on delivery, Motopit.bg may request a bank account or another suitable method for refunding the amount, where a refund via the original payment method is not technically possible.
58. Motopit.bg does not charge the consumer a fee for the refund itself resulting from the valid exercise of the right of withdrawal.
X. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
59. The right of withdrawal does not apply in the cases provided by law.
60. These may include, for example:
- goods made to the consumer's order or according to their individual requirements;
- goods that may deteriorate quickly or have a short shelf life;
- certain sealed goods which, after being unsealed, cannot be returned for reasons related to health or hygiene;
- other cases expressly provided by law.
61. An ordinary, mass-produced motorcycle part that Motopit.bg has sourced from its supplier following an order from a customer is not automatically considered a custom-made item.
62. An exception to the right of withdrawal applies only where the relevant statutory prerequisites are met.
XI. CONFORMITY OF GOODS AND WARRANTY CLAIMS
63. Motopit.bg bears the liability provided by law for the conformity of the goods sold.
64. The consumer has the statutory rights in the event of non-conformity of the goods.
The CPC states that, in the event of non-conformity or a defect that appears within 2 years of receipt, the trader is obliged to accept the consumer's warranty claim.
65. For faster processing, Motopit.bg recommends that the customer first send information to:
66. It is helpful for the notification to contain, where possible:
- order number;
- name and contact details;
- product name;
- description of the problem;
- when the problem was noticed;
- photos or other relevant information.
67. After receiving the information, Motopit.bg provides instructions for the next steps and, if necessary, for sending or providing the goods for inspection.
68. The absence of photos or the use of another method permitted by law for making the claim does not, by itself, result in the loss of statutory rights.
69. Where a claim is upheld, the rights and remedies provided in the applicable law apply.
70. A commercial guarantee provided by a manufacturer, official representative or importer does not limit the consumer's statutory rights.
XII. COMPATIBILITY, INSTALLATION AND USE
71. Some of the products sold through Motopit.bg are technical components whose proper functioning depends on suitable selection, installation, adjustment and maintenance.
72. The customer should follow the manufacturer's instructions for installation, use, maintenance and safety.
73. Where installation requires specialised tools, technical knowledge or adjustments, Motopit.bg recommends that it be carried out by a qualified workshop or specialist.
74. Motopit.bg does not carry out installation or servicing, unless expressly agreed otherwise for a specific case.
75. Incorrect installation or use contrary to the manufacturer's instructions may cause damage and a safety risk.
76. This section does not limit any statutory liability of Motopit.bg that cannot be excluded or limited.
XIII. PROMOTIONS AND PROMO CODES
77. Motopit.bg may offer:
- promotional prices;
- promo codes;
- free delivery;
- bundle offers;
- other commercial campaigns.
78. Special conditions may apply to a specific campaign, including:
- validity period;
- minimum value;
- applicable products or categories;
- restrictions on combining with other discounts;
- other clearly stated conditions.
79. Where a promo code has a validity period or special conditions, these are communicated when it is provided.
80. A promo code cannot be exchanged for its cash value, unless expressly stated otherwise.
81. When announcing discounts, Motopit.bg complies with the applicable rules on indicating the previous price. The CPC states as the previous price the lowest price applied for a period of not less than 30 days before the discount.
XIV. ORDERS AND CONSULTATIONS BY PHONE
82. The phone number 0883 20 55 35 may be used for:
- consultation about a product;
- assistance with choosing;
- checking compatibility;
- questions about an order;
- placing an order by phone.
83. For a phone order, Motopit.bg may request the necessary details about the customer, the product and the delivery.
84. Motopit.bg provides the necessary pre-contractual information and, where the law requires provision or confirmation on a durable medium, takes the necessary steps.
XV. INVOICES AND BUSINESS CUSTOMERS
85. Motopit.bg also sells goods to legal persons and other customers who wish to be issued an invoice.
86. The customer is responsible for the accuracy of the billing details provided.
87. The delivery details may differ from the billing details.
88. The rights granted by law solely to consumers do not automatically apply to transactions between traders.
XVI. USER ACCOUNTS
89. Motopit.bg may provide the option to create a user account.
90. Having a user account is not a mandatory condition for placing a standard order, unless expressly stated otherwise on the site.
91. The user is responsible for keeping their account access details confidential.
92. Motopit.bg may restrict access to an account in the event of proven abuse, fraud or violation of the law, insofar as this is permitted.
XVII. INTELLECTUAL PROPERTY
93. Motopit.bg's own texts, graphic elements, design, logo and other original materials are protected under applicable law.
94. The trademarks, images and materials of manufacturers and other third parties belong to their respective rights holders.
95. The content of the site may not be used in violation of the rights of Motopit.bg or third parties.
XVIII. PERSONAL DATA
96. Motopit.bg processes personal data for the purposes of:
- processing and fulfilling orders;
- delivery;
- invoicing;
- customer service;
- warranty claims and returns;
- compliance with legal obligations;
- other lawful purposes.
97. Detailed information about the processing of personal data is contained in Motopit.bg's separate Privacy Policy.
98. The use of cookies and similar technologies is governed by the applicable cookie policy and settings on the site.
XIX. FORCE MAJEURE AND CIRCUMSTANCES BEYOND MOTOPIT.BG'S CONTROL
99. Motopit.bg is not liable for delay or non-performance caused by force majeure or another circumstance for which it is not liable by law.
100. In the event of a significant impact on the fulfilment of an order, Motopit.bg takes reasonable steps to inform the customer and to limit the consequences.
XX. COMPLAINTS AND DISPUTE RESOLUTION

102. Motopit.bg will strive to review received complaints in good faith and to seek an amicable solution.
103. The consumer may file a complaint with the Consumer Protection Commission (CPC) and use the applicable procedures for alternative resolution of consumer disputes.
XXI. APPLICABLE LAW
104. For matters not settled in these Terms and Conditions, the applicable legislation of the Republic of Bulgaria and the applicable law of the European Union apply.
105. Disputes that arise are examined by the competent court in accordance with the applicable rules of jurisdiction.
106. These Terms and Conditions do not limit any mandatory rights granted to the consumer by applicable law.
XXII. CHANGES TO THE TERMS AND CONDITIONS
107. Motopit.bg may amend these Terms and Conditions in the event of a change in:
- applicable law;
- the functionality of the online shop;
- payment methods;
- delivery;
- the services offered;
- other objectively justified circumstances.
108. The current version is published on Motopit.bg and applies going forward from the date indicated.
109. For an order already placed, the conditions in effect at the time the relevant contract was concluded apply, unless the law requires otherwise or the parties have validly agreed otherwise.
